Priority and pledges

Registration of a secured interest with the clerk of the commercial court gives the creditor a priority right with respect to other creditors, on all of the debtor's property (real or personal property), or on certain of them. Registration of a secured interest (on the business assets or shares of a civil company) also gives a creditor a preferential right on certain assets given priority in the payment of the debt.

Any person may request from the clerk of the commercial court the state of the indebtedness, which summarises any privileges and pledges registrations, as well as the registrations made to prove the existence of a property right (lease financing arrangements, rental agreements, title retention clauses) or an outstanding debt (ex.: disputes).
