Anyone can request from the Commercial Court Registry a general report of recordings of pledges (guarantee taken by a creditor against a debtor on business assets, machinery, equipment or shares in the capital of a non-trading company to secure its debt), preferential rights (a right which the law grants to a creditor, based on the quality of its claim, to have a preferred payment position over other creditors on all or some of its debtor's assets) or protests (which concern unpaid checks or negotiable instruments), as well as recordings of financial leasing or equipment rental agreements and title retention clauses published at the Registry.
Debts owed to the government, guarantees declared by banks and financial institutions, preferential rights and pledges make up what is called the company's debt report :
- Treasury, social security and supplementary pension preferential rights represent the company's debts owed to these organizations. - Contractual pledges are guarantees taken by certain suppliers of a company to protect themselves in case of the company's default.
